The Revised Anti-Unfair Competition Law of the People's Republic of China was adopted on November 4, 2017, and shall come into force on January 1, 2018.
In contrast to the old Anti-Unfair Competition Law of the People's Republic of China, the newly revised one includes the following features:
1. It further clarifies that the general provisions of the anti-unfair competition is applied to natural person, legal person and unincorporated organization that engages in the production or distribution of commodities or the provision of services.
2. It regulates unfair competition acts by Internet technology means;
3. It enlarges the scope of protection for Intellectual Property Rights;
4. The definition of commercial bribery is clearer;
5. It extends the scope of false or misleading commercial promotion;
6. It broadens the subjects who are responsible for protection of the trade secrets;
7. It strengthens measures of administrative enforcement and raises the starting point of administrative penalty;
8. It improves the system of civil compensation on unfair competition acts.
